Purchase and Sales Agreement

Where [Breed] is noted, insert Mastiff or Bullmastiff

   Continued from legal description of puppy...

   A.    Use of the dog:

It is agreed between Breeder and Buyer that this dog is being acquired as a family companion dog or for a working dog to be used for tasks appropriate to its’ breed such as therapy dogs or for exhibition in AKC conformation, obedience or agility competitions.

    B.    Ownership:

Buyer agrees that the dog is not purchased for resale nor will it be used or trained for activities which are illegal or for which it is not suited by reason of temperament or conformation.  Specifically, it will not be used as a guard or attack dog or to hunt or fight other animals.

The Buyer agrees that he/she will not sell, transfer ownership or possession of the puppy/dog or any of his/her progeny to any person or organization whose intent is to resell (pet store), trade, or give away the puppy/dog, or use it in any experiments, laboratory or otherwise or to use it as breeding stock for a “puppy mill”.

    C.    Health:

The Breeder warrants the puppy/dog to be in good health at the time of purchase/pick-up, and has not made and does not now make further warranties as the puppy/dog’s condition after pick-up.  It is the Buyers’ responsibility to prevent illness and injury by providing necessary nutrition, fresh water, shelter and supervision.  Buyer further agrees to maintain a Raw Food Diet with homeopathy as a first choice of remedy and treatment.

Health and Hip Guarantee:  Puppy will be replaced during the first year from the next available litter if your puppy displays a congenital defect that will significantly diminishes its' quality of life OR CRIPPLING HIP DYSPLASIA with the following circumstances being met:  If your puppy has not been vaccinated before reaching one year of age, (except for rabies vaccine** after 6 months) AND the Breeder recommended diet has been followed AND the puppy has not been exercised inappropriately.  If you assert a claim for replacement due to these conditions, we must be notified immediately in writing with x-rays and medical documentation for review and verification by our veterinarian.  Puppy will be replaced if all these conditions have been met AND that surgical or pharmaceutical treatment has not been given.  Note:  all transportation costs for replacement will be the Buyer's responsibility.

**By law, the puppy/dog will be inoculated against rabies at six months to one year of age, this should be done ONLY when the puppy/dog is healthy.  Lyssin homeopathic antidote will be given at the time of vaccination to minimize the side effects of the rabies vaccine damage.  It is available from Dr. Charlie Loops in a single dose for $6.00 and 1/4 ounce bottles are also available.  Dr. Loops:  (919) 542-0442.

Additionally, male dogs have been checked that both testicles have descended at time of pick-up.  Accidents can happen with new puppy dogs, however, this contract does not cover testicle trauma after the puppy goes to his new home.

D.    Registration:

The Breeder certifies that the puppy/dog is eligible for registration under the Regulations of the American Kennel Club as a purebred [Breed] and will provide the proper forms for such registration.  Buyer agrees to attach the Breeders Kennel prefix “Cypress Run” at the beginning of the puppy/dog’s name on the registration certificate.

    E.    Ownership Responsibilities:

The Buyer agrees to maintain the puppy/dog in a humane environment and properly train and care for it.  Specifically, the puppy/dog will be create trained and a crate will be used with diligence for the first year or more of his/her life.  The puppy/dog will not be allowed to roam free and will be socialized and obedience trained appropriately.

The Buyer agrees that this puppy/dog will not be raised on slippery surfaces, limit stair climbing and jumping down from heights or out of vehicles, etc. (ramps are available from $100), as this type of activity will contribute to the breakdown of joints and growing bones, dislocation of shoulders, hips and damage elbows.

The Buyer further agrees that the puppy’s weight will be under strict supervision.  Bone ailments can be a result of poor nutrition, over feeding, over supplementing as well as over exercising.  A Diet of raw meat and vegetables together with supplements appropriate to maximize health and longevity is recommended by the Breeder, as described in The Complete Handbook for the Dog and Cat by Juliette de Barcli Levy.  Please, remember that a [Breed] puppy grows very quickly and carries a lot of weight while very young.  Your puppy may look like an adult, but it is a puppy and needs puppy care.  While your puppy does need to stretch his legs, it does not take much to tire him/her our.  Do not take your puppy jogging, hiking or for long walks.  Exercise should be slow and minimal, most structure damage is done within the first 18 months.  Always supervise your puppy when playing with other puppies, dogs and children.  Even though your puppy may seem grown up, his bones and joints are still young and developing until almost three years.  NEVER teach your PUPPY to do anything you would not want him/her to do as a 100+ ADULT.

    F.    Spaying and Neutering:

Puppies which are purchased as family companions and/or are judged not to be of show and breeding quality, will be counseled on what is the best options for the puppy/dog and the family.  If Buyer chooses not to spay/neuter,  Buyer will use diligence to make sure an accidental breeding will not occur.

    G.    Show Potential:

The Breeder will use their best judgment in evaluating the puppies as to:  Show Potential or Family Companion.  There is  no guarantee that the puppy evaluated as “Show Potential” will be successful in the show ring as an adult and no warranties are made to that effect.  The Breeders encourage owners to participate in the sport of purebred dogs and may be available to assist buyers in preparing and showing dogs, which are evaluated to be of show quality.  Breeder reserves the right of stud service of the male, all costs of collection incurred by Breeder.  **If Buyer opts to neuter male, Breeder must give written authorization to do so, or Breeder shall be reimbursed one-half of the purchase price of said puppy for loss of breeding rights.

    H.    Right of Recovery/Placement:

In the event that the Buyer’s are unable to keep the dog or provide an appropriate home in accordance with this agreement, the dog with it’s title/registration will not be transferred to any person or organization other than the Breeder, whether by sale, gift, loan or otherwise, unless agreed to by the breeder in writing.  Buyers agree to notify the Breeder if any such contingency arises and will not abandon the dog to a shelter or sell or give the dog away.  If the dog is found to have been sold or given away without the Breeder’s knowledge and said Breeder discovers this, Breeder will take legal action and original buyer of the dog will be responsible for all legal expenses incurred to recover and re-home dog.
